Delhi Development Authority in deference to the demand of allottees and its commitment to provide relief and better service to the allottees, has brought out “DDA Penally Relief Scheme-2014” which provides one time package deal of clearing all the installments along with penalty by availing rebate of 25% on balance penalty payable by the applicant. The scheme will be open from 12.03.2014 to 11.09.2014.

Flats under the General Housing Scheme and NPRS (New Pattern Registration Scheme) Scheme were allotted to a number of allottees on Hire Purchase basis. It has been found that a number of allottees have not paid their Hire Purchase Installments regularly.The scheme is also made available to allottees of Semi Cash Down and under EHS Category. Package deal has been worked out to the allottees who clear their overdue installments and interest under the “Penalty Relief Scheme-2014” availing a rebate of 25% on balance interest/penalty payable only. As per the existing terms and conditions the rate of interest is @ 12% p.a. for the first month and 18% p.a. for subsequent belated period. The rebate will be applicable to balance penalty payable by the applicant.

  1. The allottee can purchase the application form at Counter No. 11, D-Block, Ground Floor, Vikas Sadan, New Delhi.

  3. The scheme will be applicable to the allottees of following housing schemes:

    • General Housing Schemes (GENL)
    • New Pattern Registration Scheme-1979 (NPRS), also known as HUDCO scheme
    • Retiring Personnel Scheme (RPS)
    • Ambedker Awas Yojna Scheme (AAYS)
    • All Janta Schemes/EWS-HSMKJD-2001 (JANTA)
    • Allotment on Semi-Cash Down Scheme basis (SCD)
    • Expandable Housing Scheme of 1995 and 1996 (EHS)
    • HIG Housing Scheme (Hire Purchase cases)
    • Punjab Migrants (PM)
    • Kashmiri Migrants (KM)

    Penalty Relief Scheme 2014 will not Applicable to:

  1. Allotments made on cash
  2. Self Financing Scheme
  3. Commercial Flats

Eligibility for DDA Penalty Relief Scheme 2014

  1. This scheme shall be available only to those allottees who shall make payment of following dues along with the application.
    • All outstanding instalments due upto the date of application.
    • Interest/penalty on above after relief.
  2. If applicant has deposited the amount of penalty short by upto Rs. 25000/- his case will not be rejected but he will have to deposit the balance amount of demand, together with interest @ 18% p.a. from the date of application. Failure to pay this amount within three months from demand would result into cancellation of property and rejection of relief under PRS-2014.

    In case of allottees of Semi Cash down basis and EHS-1996, the benefit under penalty relief scheme will be available only if they also make balance payment i.e. Cash Down payment of pending instalments.

  3. This scheme shall also be applicable to those allottees who have already paid all due installments but penalty under the original terms and conditions of allotment still remains unpaid on account of belated payment of installments in the past. In such cases rebate will be admissible only on balance penalty which may become payable now.
  4. The past cases wherein payment of penalty in accordance with the allotment terms and conditions and DDA Hire Purchase Penalty Relief Schemes-1995, 1996, 1997, A.S. 1998, PR.S. 2001,zb07 and 2011 have already been made/settled shall not be reopened and entertained in any case.
  5. If the allottee has already deposited amount of penalty as per original terms of the scheme or earlier penalty relief scheme and penalty under this scheme is less than the amount deposited, no refund will be given and amount deposited will be treated as penalty prevalent at that point of time.
  6. The allottee is also requested to attach the photo copy of No Dues Certificate of earlier PRS, if he has availed the facilities under earlier PRS.

Salient Features of Scheme:

  1. Allottee(s) as referred to in Para 3(a) to (j) above shall be charged interest @ 12% p.a. for first month and 18% per annum for subsequent month of default in making payment of installment(s) provided they make payment as per 5(a) above.
  2. As per allotment terms of Hire Purchase Scheme, if an allottee fails to pay monthly installment, for consecutive six months, the Hire Purchase Tenancy Agreements are liable to be terminated and same may be restored against the payment of restoration charges at prescribed rates. Under the PRS 2014 no restoration charges are payable unless Hire Purchase Tenancy Agreements have already been formally terminated.
  3. 25% relief in respect of unpaid penalty (i.e. interest) on late/non-payment of installment(s).

Finance/Loan:

The allottee can avail housing loan by mortgaging the house to following institutions without prior approval of the DDA, however, an intimation regarding institution to which flat has been mortgaged must be sent to the DDA:

  1. Government of India.
  2. State Governments.
  3. Union Territory Administration.
  4. Public Sector Undertakings/Autonomous Bodies.
  5. Nationalized Banks.
  6. Life Insurance Corporation of India.
  7. General Insurance Corporation of India.
  8. Housing Development Finance Corporation.
  9. Co-operative Banks.
  10. M.C.D.
  11. N.D.M.C.
  12. All joint Sector Companies-irrespective of the percentage of share holding.
  13. University of Delhi.
  14. All Organization, Private or Public, Which receive the approval of Govt, of India, State Govt.^for the purpose of general mortgage permission and are recognized by RBI as a Housing Finance Company.
  15. All Financial Institutions extending loans to individuals for House Building, if they are leading companies with good market standing and repute say with a capital base of Rs.5 crore or so.
  16. All Financial Institutions/Banks which are controlled by RBI or the Govt, of India irrespective of the percentage of Govt, share holding.
  17. All Public Companies with a capital base of Rs. 5 Crore provided they have a scheme for granting HBA to their employees and the mortgage is required for grant of such advances.

  1. The allottee intending to avail the relief under the present scheme should use only the challan form appended with the Booklet.
  2. The allottee shall fill up the challan form correctly as per requirement of the columns either challan and shall deposit the payable amount by way of either demand draft or pay order 10 be attached with the challan. The DD/Pay Order may be drawn in favour of “DDA HOUSING-PRS 2014”. The payment codes are indicated on the bank challan. This code number should be inserted under the columns CODE in challan form and should be indicated separately.
  3. The Bank shall retain first and second copy of the challan and third and fourth copy of the challan duly acknowledged by bank shall be handed over to the allottee. The allottee shall retain fourth copy of challan for his own record and third copy would be transmitted to the concerned Sr. Accounts Officer along with the application form.

Submission of Intimation Letter of Payment:

  1. This booklet also contains a specimen intimation letter of payment of installments and interest under the present scheme. The allottee is advised to fill up the same with due care legibly and preferably in capital block letters. The name and address of the allottee should, however, be written in ‘CAPITAL BLOCK LETTERS’.
  2. The allottee has option to use either the intimation letter appended with booklet or he can also take out its photocopy for use or type it legibly.
  3. Intimation letter along with the third copy of the challan and Annexure-A can be sent either by registered post or deposited at Counter No. 11, D Block, Ground Floor, Vikas Sadan, New Delhi-110023.

Important Note:

The applicants are advised in their own interest to attach the following documents:

  • Photocopy of demand-cum-allotment letter.
  • Photocopy of challan through which initial deposit was deposited.
  • Third copy/legible photocopies of the challans in respect of all the installments paid so far.
  • Deferment letter, if any.
  • Photocopy of possession letter with proof of physical possession taken over.
  • NOC if already availed.
